Terms of service

1.The agreement

These terms are a contract between you and Scintilar (“we”, “us”) for the link-page service at scintilar.com. You must be at least 18, or the age of majority where you live, and you must be able to enter a contract. If you use the service for an organisation, you confirm you can bind it. Our privacy policy forms part of this agreement.

2.Your account

You sign in with Google. Keep your Google account secure; you are responsible for activity on your account. Tell us at once if you think someone else has access. You may claim one page handle (the name in your page address). Handles are first come, first served; we may reclaim handles that impersonate someone, infringe a trademark, or are reserved for our own use.

3.Trial, billing and cancelling

• Trial. New accounts get a 14-day free trial. A payment card is required to start it. We do not charge the card during the trial.
• Price. After the trial the plan you chose renews automatically: $6 per month or $48 per year, in US dollars, plus any tax that applies. If we change the price we will tell you at least 30 days before it affects you, and you can cancel before it does.
• Merchant of record. Payments are processed by Dodo Payments, who sell the subscription to you as merchant of record, collect the price and tax, and issue receipts. Their terms apply to the payment itself.
• Cancelling. You can cancel at any time from the billing area of your dashboard. Cancel during the trial and you pay nothing. Cancel later and the plan will not renew; your page stays public until the end of the period you have already paid for, then goes offline.
• Refunds. If you were charged and did not mean to be, for example you forgot to cancel the trial, email trionapps@gmail.com within 7 days of the charge and we will refund it. Otherwise payments are not refundable for time already used, but nothing in this section limits rights you have under consumer law where you live.
• Failed payments. If a renewal fails, we may retry it and may take your page offline until it is paid.

4.Your page and your content

Link pages are public. You keep ownership of everything you add: text, images, prices, links and so on. You give us a licence to host, copy, display and deliver that content so the service can work, for as long as it is on your page. You promise that you have the right to publish it, that it is accurate, and that it does not break the law or anyone’s rights.

You are the publisher of your page. That includes the prices, hours and claims on it, any offers you make, and your dealings with your customers.

5.What you may not publish

You may not use Scintilar to publish, link to or promote:

• phishing, scams, fake shops, fake giveaways or anything designed to trick people into handing over money, passwords or personal data;
• malware, deceptive redirects, or links that hide where they lead;
• spam, link farms, or pages whose main purpose is to boost another site’s search ranking;
• anything illegal where you or your audience are, including illegal goods, services or weapons trades, counterfeit goods, and unlicensed regulated products;
• content that sexualises minors (we report this to the authorities), or sexually explicit material;
• hate, harassment, threats, doxxing or content that incites violence;
• impersonation of another person, business or brand, or content that infringes copyright, trademarks or privacy rights;
• forms that collect sensitive personal data, passwords or payment card details.

You also may not attack, probe or overload the service, scrape it at scale, or use it to evade a ban.

6.What we remove

We can remove content, unpublish a page, or suspend or end an account if we reasonably believe it breaks these terms or the law, harms others, or exposes us or our providers to risk. We usually try to tell you first, but we may act immediately where there is a risk to visitors, such as phishing. If we end your account for abuse we are not required to refund unused time.

To report an abusive page, email trionapps@gmail.com with the page address and what is wrong. If you think we removed something by mistake, write to the same address and we will take a second look.

7.Leads and your customers

Information that visitors send through your forms belongs to you. You must use it lawfully and tell your visitors what you will do with it. You are responsible for any privacy, marketing and anti-spam obligations that apply to you. We hold the data for you as described in our privacy policy and will not use it for our own marketing.

8.Links, payments and third parties

Your page can link to other sites and payment services (such as PayPal.me, Venmo, Cash App, Stripe or Square). We do not control them, and we are not a party to anything between you and your customers. Payment links on your page send money straight to you; we do not receive, hold or process it, so we are not responsible for refunds, chargebacks or disputes. You are the seller.

Your shop. If you use the shop, you are the seller of everything in it and we are not a party to the sale. You set the products, prices, stock, delivery and refund terms, and you are responsible for describing them honestly, for taxes, and for delivering what you sell. Card payments go through your own Stripe account under Stripe’s terms: card details are entered on Stripe’s page and never reach our servers, and we take no fee or commission. If you connect Stripe, you give us a restricted key that can only create checkout sessions and the webhook that tells us a payment succeeded; we store it encrypted and you can disconnect it at any time. You may only sell goods and services that are legal where you and your customers are and that Stripe and these terms allow (no weapons, drugs, counterfeit or adult goods, and nothing on the list in section 5). We may hide a shop or product that breaks these rules.

9.What is ours

The service, its software, design and the Scintilar name and logo belong to us. These terms do not give you any right to them, other than the right to use the service while you have an account. Example pages on our website use invented names and details.

10.The service as it is

We work hard to keep Scintilar fast and available, but we do not promise it will never go down, lose data or be free of errors. We may change or retire features, and we will give notice if a change would seriously affect what you have paid for. Keep your own copy of anything you cannot afford to lose. To the extent the law allows, the service is provided “as is”.

11.Liability

Nothing in these terms limits liability that cannot be limited by law, including for fraud, or for death or personal injury caused by negligence, or any statutory rights you have as a consumer. Beyond that, and to the extent the law allows, we are not liable for indirect or consequential losses, lost profits or lost business, and our total liability to you for anything arising from the service is limited to the amount you paid us in the 12 months before the event.

You agree to cover us against claims by third parties that arise from content you publish or your breach of these terms, to the extent the law allows.

12.Ending this agreement

You can stop at any time by cancelling and asking us to delete your account. We can end the agreement if you break these terms or if we stop offering the service, in which case we will give reasonable notice and refund any prepaid time we cannot honour. Sections that by their nature should survive (such as liability and anything about money owed) do.

13.Changes and contact

We may update these terms. For changes that matter we will tell you by email or in the dashboard at least 30 days ahead; carrying on after that means you accept them, and you may cancel instead. If a part of these terms is found unenforceable, the rest stays in force. Questions: trionapps@gmail.com.
